2. Scope
These Terms govern your access to and use of the website odapyn.com and the Oda product published by Odapyn SAS. By using the Services you agree to these Terms. If you do not agree, do not use the Services.
3. Accounts
To use certain features of the Oda product you need an account. You agree to:
- Provide accurate information when you register;
- Keep your credentials confidential and secure;
- Be responsible for all activity under your account;
- Notify us promptly of any unauthorised use.
4. Acceptable use
You agree not to use the Services to:
- Break the law, infringe intellectual property, or violate third-party rights;
- Send spam, phishing, or unsolicited bulk communications;
- Publish content that is unlawful, defamatory, hateful, harassing, sexually explicit involving minors, or otherwise abusive;
- Attempt to probe, scan, or breach the security of the Services;
- Reverse-engineer the Services, except to the extent permitted by law;
- Use the Services to build a directly competing product.
We may suspend or terminate accounts that violate these rules.
5. Third-party platforms
The Oda product can connect to third-party platforms (Meta, Instagram, Google, Stripe, and others) so that you can publish content, run ads, or accept payments on your accounts. You are solely responsible for complying with the terms and policies of those platforms. Odapyn acts only on your instructions and within the scope of the permissions you grant.
6. AI-generated content
The Services use artificial intelligence to help you create content, decisions, and workflows. You are responsible for reviewing AI-generated outputs before publishing or acting on them. AI systems can be wrong, produce outdated information, or generate content that is inappropriate for your context. Odapyn makes no warranty as to the accuracy, completeness, or fitness of AI-generated content for any particular purpose.
7. Your content
You retain ownership of all content you upload, create, or generate using the Services (“Your Content”). You grant Odapyn a worldwide, non-exclusive, royalty-free licence to host, store, process, and transmit Your Content strictly for the purpose of operating the Services. We do not use Your Content to train foundation models.
8. Subscriptions, pricing & payments
- Paid plans are billed in advance on a monthly or annual basis through our payment processor (Stripe).
- Prices are shown in euros and exclude VAT, which is added where applicable.
- You can cancel at any time from your account. Cancellation takes effect at the end of the current billing period.
- Amounts already paid are non-refundable, except where required by law.
9. Right of withdrawal (consumers)
If you are a consumer established in the European Union, you have a 14-day right of withdrawal on paid digital services. By starting to use the Services during that period you expressly waive this right once the service has been fully performed.
10. Intellectual property
The Services, including the website, the Oda product, and the underlying software, are the intellectual property of Odapyn SAS. Except for the licences granted in these Terms, nothing here transfers any right to you.
11. Warranties & liability
The Services are provided “as is” and “as available”. To the maximum extent permitted by law, Odapyn disclaims all implied warranties. Our aggregate liability for any claim arising out of the Services is capped at the amounts you paid us in the 12 months preceding the event giving rise to the claim. We do not exclude liability for gross negligence, wilful misconduct, or any other liability that cannot be excluded under applicable law.
12. Termination
You can stop using the Services at any time. We may suspend or terminate your account in case of serious breach of these Terms, legal requirement, or extended inactivity. Upon termination, your right to use the Services ceases; sections that by their nature should survive (IP, liability, governing law) will continue to apply.
13. Changes to these Terms
We may update these Terms to reflect changes to the Services or to comply with law. We will post the updated version on this page and update the “last updated” date. For significant changes we will notify active users by email where appropriate.
14. Governing law & jurisdiction
These Terms are governed by French law. Any dispute shall first be attempted to be resolved amicably. Failing that, the courts of Paris have exclusive jurisdiction, subject to any mandatory rules of consumer protection that apply to you.
